By accessing or using the BookingFish.ca platform, you agree to be bound by these Terms of Service. If you do not accept these terms, please do not use the platform.
1. Definitions
- "Platform": the BookingFish.ca website and all associated services;
- "Member": a fishing guide, outfitter, or operator registered on the platform;
- "Client": any person making or attempting to make a booking;
- "Booking": any confirmed transaction between a member and a client via the platform;
- "We": BookingFish.ca and its operators.
2. Access to the Platform
Access to the platform is restricted to adults (18 years and older). By creating an account, you declare that you:
- Are at least 18 years of age;
- Provide accurate, complete, and up-to-date information;
- Are responsible for the security of your login credentials;
- Will immediately notify BookingFish of any unauthorized access to your account.
3. Services Offered
BookingFish is a booking management platform for fishing guides and nautical operators. The platform offers:
- Creation and management of an online booking calendar;
- Integration of a booking form on your WordPress site via the BookingFish Calendar plugin;
- Online gift certificate sales;
- Payment management via Stripe Connect Express;
- Access to a secure member dashboard.
4. Registration and Member Accounts
Registration on the platform is subject to acceptance by BookingFish. We reserve the right to refuse or terminate any account without notice if:
- The information provided is inaccurate or fraudulent;
- The member violates these terms;
- The member engages in behavior harmful to the platform, other members, or clients.
5. Subscriptions and Billing
Use of the platform may be subject to subscription fees depending on the plan chosen. The following conditions apply:
- Subscriptions are billed according to the selected period (monthly or annual);
- Payments are processed securely via Stripe;
- No refunds are granted for subscription periods already started, unless required by law;
- BookingFish reserves the right to modify its pricing with 30 days' notice;
- In case of non-payment, access to premium features may be suspended.
6. Booking Payments
Payments made by clients during a booking are processed directly by Stripe Connect Express:
- Funds are deposited directly into the member's bank account;
- BookingFish does not act as a financial intermediary and has no access to member funds;
- Stripe processing fees are the responsibility of the member according to current Stripe rates;
- In case of a payment dispute (chargeback), the member is responsible for providing the necessary documentation to Stripe;
- BookingFish cannot be held responsible for Stripe service failures or interruptions.
7. Member Obligations
As a member, you agree to:
- Keep your profile information accurate and up to date;
- Comply with all applicable laws, including regulations regarding fishing activities and required permits;
- Honor confirmed bookings except in cases of force majeure;
- Inform your clients of cancellation conditions before booking;
- Not publish false, misleading, offensive, or illegal content;
- Protect the confidentiality of your clients' data;
- Not attempt to divert clients from the platform to avoid service fees.
8. Prohibited Uses
It is strictly prohibited to use the platform for:
- Any illegal or fraudulent activity;
- Unauthorized collection of personal data;
- Sending unsolicited communications (spam);
- Attempting to compromise platform security;
- Impersonating another person or company;
- Publishing content that infringes on third-party rights.
9. WordPress Plugin — BookingFish Calendar
The free BookingFish Calendar plugin allows you to embed your booking calendar on your own WordPress site. Its use is subject to the following conditions:
- The plugin requires an active member account on BookingFish.ca;
- The plugin communicates with the BookingFish.ca API to retrieve your embed codes — your password is never stored on your WordPress site;
- A secure authentication token (valid for 30 days) is stored in your WordPress database;
- BookingFish is not responsible for incompatibilities with third-party themes or plugins.
10. Intellectual Property
All platform content (logo, design, text, source code) is the exclusive property of BookingFish.ca and is protected by Canadian copyright law. Reproducing, distributing, or modifying this content without prior written authorization is prohibited.
Members retain ownership of their content (photos, descriptions, activity information) and grant BookingFish a limited license to display it on the platform as part of the service.
11. Limitation of Liability
To the extent permitted by applicable law:
- BookingFish is not liable for indirect, incidental, or consequential damages resulting from use of the platform;
- BookingFish is not responsible for disputes between members and clients regarding the performance of booked activities;
- BookingFish does not guarantee continuous platform availability and may perform maintenance with or without notice;
- BookingFish's total liability is limited to the amount paid for the service during the last 3 months.
12. Cancellations and Refunds
Cancellation policies are defined by each member for their own activities. BookingFish does not intervene in cancellation disputes between members and clients. It is the member's responsibility to:
- Clearly communicate their cancellation policy before booking;
- Manage refunds directly through their Stripe dashboard;
- Notify BookingFish of any exceptional situation requiring intervention.
13. Termination
You may terminate your account at any time by contacting us at support@bookingfish.ca. BookingFish may terminate or suspend your access without notice in case of a violation of these terms. Upon termination:
- Your data will be retained for 90 days then deleted (unless required by law);
- Pending bookings must be honored or cancelled according to your policy;
- No refund for the remaining subscription period will be granted.
14. Modifications to Terms
BookingFish reserves the right to modify these terms at any time. Active members will be notified by email at least 30 days before changes take effect. Continued use of the platform after this period constitutes acceptance of the new terms.
15. Applicable Law
These terms are governed by the laws in force in Canada and the province of Quebec. Any dispute will be subject to the exclusive jurisdiction of the competent courts of Quebec.
